IMMEDIATE
My telegram No. 1532 [of November 30th: extra- territoriality],
United States Government received reply of Chinese Government to their counter-proposals on 8th December. contained following points in regard to text of treaty itself.

2. Additional article. Chinese Government withdraws proposal for new Article 1 and accepts American modification of preamble. You should still ask for our own wording, which differs somewhat from the American.
(iv).
3. Article 3 (ii), Article 4 (ii) and Chinese Government withdraws proposal for additional language at the end of comparable clauses in American draft. Phrase concerning "legitimate rights" is apparently retained and you should also press for retention.
4. Article 5 (i). Chinese Government accepts proposed revision of the end of the first sentence beginning "of fraud or of fraudulent or other dishonest practices". Chinese
Government desires to retain restriction on alienation but accepts wording as in paragraph 2 of exchange of notes.
5. Comments concerning exchange of notes are contained in a separate telegram.
